Contract

When you place an order with “NORTH SOMERSET FOOTWEAR ” your order is accepted as an invitation to purchase only. The order confirmation is not a guarantee that the goods will be supplied. We must receive payment before your order can be dispatched. We reserve the right to cancel your order if we have insufficient stock, or do not deliver to your area, or the product was listed at an incorrect price. We will notify customers of cancellations via email.

Prices

The prices of products are displayed on our site and include VAT at 20%. Overseas orders may be subject to import duties and taxes. We have no control over this, and the purchaser may have to pay any charges.

Products & Images

We make every effort to ensure that colours appear as realistic as possible. However, due to the constraints of digital reproduction on different web browsers, we cannot guarantee exact colour depiction. Every care is taken to ensure descriptions and measurements are accurate, however slight variations may occur. Length measurements are approximate and vary according to the size of the item.

Delivery

The stated delivery times are estimates only. Delivery dates as we follow the guidelines set out by the manufacturer. The purchaser will pay the delivery charges that we incur due to the purchaser not signing in full.

Liability

Save as precluded by UK law, we will not be liable to you for any indirect or consequential loss, damage or expenses (including loss of profits, business or goodwill) howsoever arising out of any problem you notify to us under this condition. We shall have no liability to pay any money to you by way of compensation, other than to refund to you the amount paid by you for the goods in question.

You must observe and comply with all applicable regulations and legislation, including obtaining all necessary customs, import or other permits to purchase goods from our site. The importation or exportation of certain types of goods to you may be prohibited by certain national laws. We make no representation and accept no liability in respect of the export or import of the goods you purchase.

Events beyond our control

We shall have no liability to you for any failure to deliver the goods you have ordered or any delay in doing so or for any damage or defect to goods delivered that is caused by any event or circumstance beyond our reasonable control. This includes, without limitation, strikes, lock-outs and other industrial disputes, breakdown of systems or network access, flood, fire, explosion or accident.

Invalidity

If any part of these terms and conditions is unenforceable (including any provision in which we exclude our liability to you) the enforceability of any other part of these conditions will not be affected.

Warranty

We guarantee the use of our footwear and clothing against manufacturing defects and being waterproof for a period of 12 months from the original date of purchase, provided that your item has been cared for sufficiently. Outside of your 12 month period will be dealt with at the discretion of the NORTH SOMERSET FOOTWEAR LTD head office. If you have a query regarding the quality of your items, it is best to send this through to us by email with pictures attached for us to investigate. We will then advise your best next steps after inspection of your case.

THESE TERMS AND CONDITIONS SHALL BE GOVERENED BY AND CONSTRUED IN ACCORDANCE WITH THE LAWS OF ENGLAND AND WALES.
